OFFICIAL RULES

• NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR TO WIN. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED.
  
• SPONSOR: The sponsor of the Sweepstakes is Northern New England Passenger Rail Authority (NNEPRA) Amtrak Downeaster, 75 West Commercial St, Suite #104, Portland, ME 04101.
• SWEEPSTAKES PERIOD: The Sweepstakes begins on November 27, 2023 at 9:00 a.m. Eastern Time (“EST”) and ends on December 11, 2023 at 11:59 p.m.
• ELIGIBILITY: The Sweepstakes is open only to residents of Maine, New Hampshire, and Massachusetts, US., who are 18 years of age or older as of their time of entry. Employees, including their family (parents, children, siblings, spouse) and members of their household (whether or not related), of Sponsor and its subsidiaries, affiliates, parent companies, distributors, divisions, agencies or of any related entity, including any consultants to Sponsor, are not eligible to participate in the Sweepstakes. All federal, state and local laws and regulations apply. Participation in the Sweepstakes constitutes entrant's full and unconditional agreement to these Official Rules and Sponsor's decisions, which are final and binding in all matters related to the Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth in these Official Rules.
• PRIZE: One (1) winner will receive two (2) round-trip Downeaster tickets, a swag pack (includes branded Amtrak Downeaster merchandise), and a $200 Visa Gift Card. The Prize cannot be redeemed for cash and may not be substituted or transferred by the winner. WINNER IS RESPONSIBLE FOR REPORTING AND PAYING ANY AND ALL INCOME, SALES OR EXCISE TAXES THAT MAY APPLY TO ACCEPTING A PRIZE; SPONSOR IS NOT RESPONSIBLE FOR AND WILL NOT PAY ANY SUCH TAXES.
• ODDS: The odds of winning depend upon the number of eligible entries received.
• HOW TO ENTER: There are four (4) ways on how to enter. (1) Follow Amtrak Downeaster's Facebook and/or Instagram pages, (2) Share the post to your Instagram and/or Facebook page, (3) Tag two friends in the comments of the Amtrak Downeaster Instagram and/or Facebook post, (4) Enter your email address on the Amtrak Downeaster website. Participants may enter a total of four (4) times, limited to one entry per person for each of the four (4) methods of entry. Entries must be received before the End Date. Sponsor is the official timekeeper for the Sweepstakes. All entry information and materials become the property of Sponsor and will not be acknowledged or returned. Except as otherwise contemplated in these Official Rules, and to the extent entrants may otherwise elect at the time of entry, personal information collected in connection with the Sweepstakes will be used in accordance with the online privacy policy available at https://policies.google.com/privacy. Any attempt by any entrant to obtain more than one entry by using multiple/different email addresses, identities, registrations and logins, or any other methods will void such entries and that entrant may be disqualified. Use of any automated or computer system to participate is prohibited and will result in disqualification. Normal Internet access and usage charges imposed by your online service may apply. If entering via mobile device, normal phone/data and usage charges imposed by your phone service may apply.Incomplete, corrupted, or untimely entries are void and will be disqualified. Sponsor and its agencies are not responsible for lost, late, incomplete, damaged, stolen or misdirected entries; lost, interrupted, or unavailable network, server, or other connections; or miscommunications, computer or software malfunctions, telephone transmission problems, technical failures, garbled transmissions, damage to a user's computer equipment (software or hardware), or other errors or malfunctions of any kind, whether human, mechanical, electronic or otherwise. Proof of submission will not be deemed to be proof of receipt by Sponsor. In the event of a dispute as to the identity of an entrant, the authorized account holder of the email address associated with the entry used to enter will be deemed to be the entrant or participant. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider, Internet service provider, or other organization (which may include an employer) responsible for assigning email addresses for the domain associated with the submitted address. The potential winner may be required to show proof of being the authorized account holder. Entries specifying an invalid, non-working, or inactive email address will be disqualified and ineligible to win. Entrant's social media profiles must be keeping with Sponsor's image or they may be disqualified.
• WINNER SELECTION: The winner will be determined by random selection conducted by the Sponsor among all eligible entries by December 15, 2023. All results of the selections are final and binding, subject to these Official Rules. In the event a winning entry is discovered to be invalid for any reason whatsoever or the person who submitted the winning entry fails to comply with these Official Rules prior to delivery of the prize, the prize may be forfeited and awarded to an alternate winner. If by reason of a printing, computer or other error, more prizes are claimed than the number set forth in these Official Rules, all persons making purportedly valid claims will be included in a computerized random selection to award the advertised number of prizes available. No more than the advertised number of prizes will be awarded.
• NOTICE TO WINNER: Attempts to notify potential winners will be made using the Instagram, Facebook, or email address provided at entry. Sponsor is not responsible for other communication problems of any kind. Sponsor will message you directly from the official Amtrak Downeaster account/email address. Sponsor is not responsible for any fraudulent activity, scams, or spam attempts that may try to deceive you into believing you have won. If, despite reasonable efforts, a potential winner does not respond within 48 hours of the first notification attempt (or such shorter time as exigencies may require), or if the prize or prize notification is returned as unclaimed or undeliverable to such potential winner, such potential winner will forfeit his or her prize and an alternate winner may be selected.
• SHIPPING: The giveaway winner will have their prize mailed to the address they provide to the Sponsor after being selected as the winner.
• SOCIAL NETWORK DISCLAIMER: This promotion is in no way sponsored, administered, or associated with Google, Facebook, or Instagram, Inc. By entering, entrants confirm that they release Google, Facebook, or Instagram, Inc. of responsibility and agree to Google, Facebook, or Instagram, Inc. ’s terms of use.
• EXCLUSION OF VISA PRODUCTS AND TERMS: This Sweepstakes is not affiliated with, endorsed, or sponsored by Visa. Any references to Visa products or terms are for informational purposes only and do not imply any endorsement or partnership with Visa. The Sponsor is not responsible for any issues or difficulties that may arise with the functionality or acceptance of the Visa Gift Card. Any concerns or problems related to the Visa Gift Card should be directed to the card issuer, as the Sponsor does not have control over its operation or usage.
• LIMITATION OF LIABILITY; DISCLAIMER OF WARRANTIES: Sponsor is not responsible for telecommunications, network, electronic, technical or computer failures of any kind, including any which may affect your entry or the Sweepstakes. Sponsor is not responsible for lost, stolen, misdirected, mutilated, late or illegible entries. Entries not in compliance with these Official Rules are disqualified. Sponsor shall have the absolute right to determine if an entry is in compliance with these Official Rules without notice to the person attempting to enter.
• CONDITIONS: By entering the Sweepstakes, each participant warrants that they have read and agrees to abide by these Official Rules and that they are not prohibited from participating in the Sweepstakes. Each participant agrees to release, discharge, indemnify and hold harmless Sponsor and its parents, subsidiaries, affiliates, shareholders, employees, officers, directors, agents, representatives, advertising and promotion agencies and prize suppliers from any liability arising from or related to the Sweepstakes, including without limitation, personal injury, death, property damage, or claims based on publicity rights, defamation, or invasion of privacy. By entering the Sweepstakes, participants consent to the use of their name, likeness, image and biographical data for advertising and promotional purposes without additional compensation, except where prohibited by law. BECAUSE SPONSOR COLLECTS PERSONAL INFORMATION FROM PARTICIPANTS ENTERING THE SWEEPSTAKES, SPONSOR ENCOURAGES ALL PARTICIPANTS TO REVIEW ITS PRIVACY POLICY, WHICH CAN BE REVIEWED AT https://policies.google.com/privacy. Sponsor reserves the right to suspend or cancel the Sweepstakes or modify these Official Rules as necessary for any reason or as required by applicable law. Sponsor reserves the right, at its sole discretion, to disqualify from the Sweepstakes, and ban from any future promotions, any person it believes to have intentionally violated these Official Rules or tampered with any element of the Sweepstakes without notice to the disqualified or banned person. ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
